代位する

「代位する」の英語

「代位する」は英語で subrogate と言います。保険会社などが保険金の支払い後に契約者の請求権を引き継ぐ、法律・保険実務の専門語で、日常会話では使いません。

保険会社などが契約者の請求権を引き継ぐ法律用語です。

保険会社は保険金を支払った後、借主の権利を代位取得しました。

subrogateは、中世ラテン語のsubrogare（sub＝下＋rogare＝任命する）が語源で、『代わりに任命する』が保険法で『権利を代位して求償する』の意味に定着した。
