「違約」の英語
「違約」は英語で breach of contract と言います。契約上の義務や約束に違反することを指す、法律やビジネスでよく使われる表現です。不履行という行為に焦点を当てる場合は nonperformance や failure to perform も使えます。

「違約」を英語にするときのよくある間違い
× The company made nonperformance of the contract.
○ The company failed to perform its contractual obligations.
nonperformance は make と組み合わせて使わず、義務を履行しなかったことは fail to perform one's contractual obligations と表すのが自然です。
× 違約金を nonperformance fee と言う。
○ 違約金は a contractual penalty や liquidated damages と言います。
違約金は不履行そのものではなく、契約違反に対して支払う金銭なので、nonperformance fee とは言いません。
