事実上の違反

「事実上の違反」の英語

「事実上の違反」は英語で constructive breach と言います。契約上の不履行や拒絶などが、契約を実質的に破ったものとして法的に評価される場合に使う法律用語です。日常会話ではあまり使いません。

constructive breachは、constructive（解釈上「～と見なす」）とbreach（違反）の結合で生まれ、文字どおりの違反がなくても事実上違反と扱う法用表現である。

「事実上の違反に当たる」という意味では、amount to を使うと自然です。また、doing nothing より the failure to act のほうが法律文書に適した表現です。
