「類推実施の原則」の英語

「類推実施の原則」は英語で rule of cy pres と言います。慈善目的の遺贈や信託で、寄付者の一般的な慈善意図をできるだけ近い形で実現する法的な原則を指します。判例や法文書で使う専門用語です。

rule of cy presは、中世フランス語の句 cy pres（可能なかぎり近く）に由来し、英米法で慈善目的が達成不能な場合に目的を『できるだけ近い』形で変更して実現する手続を指す。
